This is a pre-authorized charged. Before driver is dispatch ride will be charged first. 1. CONTRACTUAL RELATIONSHIP A. These Terms of Use ("Terms") govern the access or use by you, an individual and on behalf of your minor’s services (the "Services") made available by T&F Enterprise, LLC ("Cabs 4 Kiddos”). PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES. In these Terms, the words "including" and "include" mean "including, but not limited to." B. Your use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Cabs 4 Kiddos. If you do not agree to these Terms, you may not use the Services. Cabs 4 Kiddos may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason. C. Cabs 4 Kiddos may amend the Terms related to the Services from time to time. Amendments will be effective upon Cabs 4 Kiddos posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service(s). Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended. 2. Payment A. All packages are on prepayment terms. B. Refunds will be determined on a case by case basis at the discretion of Cabs 4 Kiddos. C. Cancellations not made within 24 hours will incur a charge of 50% of the package price. Cabs 4 Kiddos understands that emergencies do happen and will compensate 1 cancellation for 1 trip not cancelled within the allotted time. 3. Transportation A. Cabs 4 Kiddos is authorized to pick up and/or drop off my child and transport them in a Cabs 4 Kiddos vehicle. I understand that my child will be properly secured in a seat belt or approved child safety seat. B. All prepaid flat rate, lump sum rides (899.99 =60 or 449.99 +30) must be used within 30 days from purchase date. C. Each child should be ready and on time for their scheduled trip, parents understand that there is a 5 minute grace period and a $5.00 waiting fee for each 5 minutes over the scheduled pick up time up to 15 minutes. Parents will automatically be charged this fee to the credit card on file. D. Children will only be released to persons authorized by parent or guardian in registration paperwork, parents can update this information under registration with the appropriate documentation at any time. E. It is the parent’s responsibility to inform Cabs 4 Kiddos of any pick-up/Drop off procedures at the child’s school when booking a trip. Failure to provide this information could affect assessed waiting fee charges. F. Cabs 4 Kiddos is authorized to secure emergency medical care for my child when I cannot be immediately reached at the time of an emergency. You understand that you will be responsible for any emergency medical charges assessed. 4. DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY. A. DISCLAIMER. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CABS 4 KIDDOSDISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. B. LIMITATION OF LIABILITY. CABS 4 KIDDOS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF CABS 4 KIDDOSHAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CABS 4 KIDDOS SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; CABS 4 KIDDOSSHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND Cabs4Kiddos REASONABLE CONTROL. IN NO EVENT SHALL CAB4Kiddos TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED TWO HUNDRED FIFTY U.S. DOLLARS (US $250). THE LIMITATIONS AND DISCLAIMER IN THIS SECTION 4 DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. C. INDEMNITY. You agree to indemnify and hold Cabs 4 Kiddos and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection with: (i) your use of the Services and (ii) your breach or violation of any of these Terms. 5.
